ERISA stands for the Employee Retirement Income Security Act. This federal law protects all employee benefits packages in the private industry. The ERISA appeal process is very strict compared to the private industry process.

Administrative Record

Unlike the appeals process within the private industry, you will not be allowed to offer additional evidence or speak on your behalf.

All evidence considered for your appeal must be placed within your administrative record.  

This evidence must be submitted to an impartial judge 180 days from the time of your denial letter. The impartial judge will consider your administrative record and either uphold your denial or overturn it.
