Attorney Michael Bartolic wins ERISA litigation on appeal

Chicago, July 29 — Bartolic Law (https://www.chicagodisabilitylawyers.com/) took on the ERISA litigation case for a client who had been fighting the Teamsters Pension Fund for more than 2 ½ years. In Schane v. the International Brotherhood of Teamsters Local 710 Pension Fund Pension Plan, Attorney Bartolic and his team of ERISA lawyers persuaded the appeals court that the Teamsters Plan Trustees were “arbitrary and capricious” in their interpretation of the plan when they decided that Mr. Schane was “retired,” as defined in the plan. The ERISA litigation was triggered when Mr. Schane continued employment, but not under the Covered Employment agreement of collective bargaining and the teamsters calculated his pension amount at a much lower rate.

“Basically, the teamsters were calculating pensions for some people one way, and other people another way,” said attorney Bartolic. “What the appeals court said is that you can’t have it both ways.” Attorney Bartolic and his team of ERISA lawyers saw to it that Mr. Schane’s pension would be paid at the higher amount that he contended in the original case.
